Welcome to Noesis! These Terms of Service ("Terms") govern your use of the Noesis service, including our mobile application and related services (collectively, the "Service"), operated by Room to Grow LLC, a California limited liability company ("Noesis," "we," "us," or "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
iOS App License: The Noesis iOS application is licensed under Apple's standard Licensed Application End User License Agreement (EULA). These Terms govern the Service, your account, and your relationship with Noesis.
Your use of the Service is also subject to our Privacy Policy.
Noesis is a science-backed personal growth application grounded in cognitive neuroscience, psychology, and behavioral science. The Service provides tools for guided breathwork, personalized AI-generated meditations and visualizations, gratitude and reflective journaling, affirmation creation and delivery, AI-generated weekly action plans, habit and streak tracking, educational podcast content, and optional integrations with Apple Health and Apple Reminders.
Your personal content is transmitted over encrypted connections and stored on secure, access-controlled infrastructure. We do not sell your data, use it for advertising, or train AI models on it. See our Privacy Policy for details.
You must be at least 18 years old, provide accurate registration information, maintain only one account, and not have been previously suspended from the Service.
You are responsible for maintaining your account credentials and all activity under your account. Notify us immediately of unauthorized use at support@trynoesis.app.
We reserve the right to refuse service, terminate accounts, or restrict access at our sole discretion.
You may delete your account at any time via Settings → Delete Account. This permanently removes all your data. See our Privacy Policy for details.
By creating an account, you consent to receive service-related emails, in-app notifications, and push notifications (reminders, affirmations, check-ins, if enabled). You control notification frequency via in-app settings and may opt out through device settings or by contacting us.
Noesis includes content moderation to ensure the safety and wellbeing of our users. Content that references violence or harm may be blocked or redirected. Content referencing self-harm triggers crisis resources (988 Lifeline). We reserve the right to suspend accounts that repeatedly misuse moderation safeguards.
You retain ownership of all content you create in Noesis. We do not claim ownership of your content.
By creating content, you grant us a worldwide, non-exclusive, royalty-free license to store, process, and display your content solely to operate the Service. This includes processing content for AI-powered features and technical purposes (audio encoding, file storage). This license terminates when you delete your content or account.
Meditation scripts, coach messages, action suggestions, reflection prompts, journal insights, and other AI-generated content are for personal development and encouragement only. You understand that:

The Service, including design, features, logos, guide voices, bundled audio, podcast episodes, and protocol structure, is owned by Noesis and protected by intellectual property laws.
Send DMCA notices to admin@roomtogrowllc.com with a description of the copyrighted work, location of the infringement, your contact information, good faith statement, statement under penalty of perjury, and signature.

Your use of these services is subject to their respective terms. We are not responsible for third-party availability or operation.
Your vision details and optional journal context are used to create a personalized meditation script, which is converted to voice narration. Audio is processed on your device and stored for repeated use.
Personalized weekly messages and action suggestions are generated based on your visions, reflections, and progress. They are motivational, not therapy or professional advice.
The optional voice clone creates narration in your voice. You record a standard script (~2-3 minutes), processed by our voice synthesis provider. You may delete your clone at any time. Voice cloning is rate-limited.
AI features are subject to usage limits to manage costs and ensure fair access. We may modify, limit, or discontinue AI features at any time, including changes to models, providers, limits, or content generation.
Podcast episodes are owned by Noesis, may be streamed or downloaded for personal use only, and may not be redistributed without permission. Content is educational, not professional advice.
Noesis is a personal development and mindfulness tool. It is not a medical device, therapy substitute, or mental health treatment.

The Service may be temporarily unavailable due to maintenance or circumstances beyond our control. We may modify, suspend, or discontinue any feature at any time. Previously generated content stored locally on your device remains accessible offline.
Noesis offers premium subscription tiers. Features are available through in-app purchases managed by Apple. Subscription terms, pricing, and included features are displayed in the App before purchase. Subscriptions are subject to Apple's in-app purchase and auto-renewal terms. You can manage or cancel your subscription through your Apple ID settings.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, error-free, or that AI-generated content will be accurate or suitable for your situation. You use the Service at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOESIS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, RELIANCE ON AI-GENERATED CONTENT, OR ANY HEALTH OR WELLNESS OUTCOMES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow these exclusions. In such cases, our liability is limited to the greatest extent permitted by law.
You agree to indemnify and hold harmless Noesis and its officers, directors, employees, and agents from claims, damages, losses, and expenses arising from your use of the Service, violation of these Terms, violation of third-party rights, or content you upload.
We may suspend or terminate your access at any time for violations, misuse, inactivity, or law enforcement requests. You may delete your account via Settings → Delete Account. Sections that by nature should survive termination (Disclaimer, Liability, Indemnification, Dispute Resolution) shall survive.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Disputes shall be resolved exclusively in state or federal courts in San Francisco County, California.
TO THE EXTENT PERMITTED BY LAW, DISPUTE RESOLUTION WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Nothing in these Terms affects statutory consumer rights that cannot be waived by contract.
We may update these Terms. We will notify you of material changes by posting a notice in the App and updating the effective date. Continued use after changes constitutes acceptance.
